Two of the Supreme Courtroom’s conservative justices simply handed Joe Biden a significant win on the southern border.

The Supreme Courtroom cleared the way in which Monday for US Border Patrol officers to chop via razor-wire fencing that Texas put up alongside the Rio Grande River.

The 5-4 ruling is a big win for the Biden administration, with Justices John Roberts and Amy Coney Barrett splitting with the courtroom’s different conservatives and siding with liberal justices Elena Kagan, Sonia Sotomayor, and Ketanji Brown Jackson.

Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, and Brett Kavanaugh dissented.

Monday’s ruling comes after the Biden administration requested the Supreme Courtroom to vacate an injunction that the Fifth Circuit Courtroom of Appeals imposed last month, which briefly paused a lower-court ruling that allowed federal brokers to chop via Texas’ razor-wire fencing alongside the border.

The appeals courtroom put that call on maintain whereas it reviewed the case, prompting the Biden administration to ask the Supreme Courtroom to intervene.

The US Justice Division alleged in a court filing that Texas Nationwide Guard troops had erected razor-wire obstacles alongside a 2.5-mile stretch of the US-Mexico border, in addition to new fencing farther inland.

“That fencing additional restricts Border Patrol’s capability to succeed in the river particularly areas,” the Justice Division said.

It added that Texas’ actions “reveal an escalation of the State’s measures to dam Border Patrol’s capability to patrol and even to surveil the border and be ready to reply to emergencies.”
